This Terms of Use Agreement (the “Terms of Use”) is entered into by and between you and Castañeda Law Firm PLLC, a Texas professional limited liability company (“CLF” or “Castañeda Law Firm”), the owner and operator of the site accessible through www.castanedalawfirm.com (the “Website”). By using the Website, you accept and agree to be bound and abide by these Terms of Use. If you do not agree to these Terms of Use, you must not access or use the Website. Please review these Terms of Use carefully as it forms a binding contract between you and CLF. CLF may change these Terms of Use at any time without notice. Your continued use of the Website following the posting of revised Terms of Use means that you agree and accept the changes.
All lawyers referenced in this Website, unless otherwise indicated, are not certified by the Texas Board of Legal Specialization. Legal results obtained depend on the facts of each case and prior results do not guarantee a similar outcome.
By using this Website, you represent and warrant that you are of legal age to form a binding contract with CLF. This Website is not directed at children under the age of 13 and does not knowingly collect personal information from children under the age of 13. Governing Law and Venue. This Website (excluding linked sites) is controlled by CLF from its offices within the State of Texas, United States of America. As each of these jurisdictions has laws and regulations that may differ from those of Texas, by accessing this Website both you and CLF agree that the statutes and laws of the State of Texas, without regard to conflicts of laws principles thereof, will apply to all matters relating to use of this Website (whether grounded in tort, contract, law or equity). In the case of a dispute, you and CLF agree any litigation arising between the parties hereto shall be brought only in the state or federal courts having subject matter jurisdiction in Travis County, Texas. You and CLF hereby irrevocably and unconditionally consent to the jurisdiction of any such court and hereby irrevocably and unconditionally waive any defense of an inconvenient forum to the maintenance of any action or proceeding in any such court, any objection to venue with respect to any such action or proceeding, and any right of jurisdiction on account of the place of residence or domicile of any party thereto.
Waiver and Severability. No waiver by CLF of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of CLF to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.
Entire Agreement. The Terms of Use constitute the sole and entire agreement between you and CLF with respect to the Website and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website.
